Terms of service

1. General provisions
These terms govern the use of the Bajoo website at bajoobajoo.com (the "Service").
The Service is owned and operated by (the "Operator"):

Using the Service constitutes acceptance of these terms in full.
2. Definitions
- User - a natural person aged 18 or older who has created an account in the Service.
- Child - a minor (0-10 years old) whose profile has been created in the Service by a User.
- Story - content generated by the Service using artificial intelligence based on parameters provided by the User.
- Account - the User's individual, password-protected account in the Service.
3. Rules for using the Service
The User commits to:
- Providing truthful data on registration.
- Not sharing their account with third parties.
- Using the Service for its intended purpose.
- Not attempting to bypass content moderation safeguards.
The Operator reserves the right to suspend the account of a User who breaches these terms.
4. AI-generated content
Stories are generated automatically using artificial intelligence models. Each story passes through a multi-layer moderation system designed to keep content safe for children.
The Operator makes every effort to produce content suitable for the age group indicated, but does not guarantee that every generated piece will fully match the User's expectations.
The User retains the right to use generated stories for personal use.
5. Payments, packages and subscription
The Service offers both free and paid features. The scope and prices of paid services are always shown in the Service before an order is placed. All prices are in Polish zloty and include VAT.
Paid services come in two forms:
- Subscription - access to a pool of minutes that renews each billing period. The contract runs for an indefinite term and is charged in advance for each period. You can cancel at any time in your account settings or by writing to [email protected]; cancellation takes effect at the end of the paid period, and you keep full access until then.
- Top-up - a one-off purchase of additional minutes, with no automatic renewal.
Payments are handled by PayPro S.A. (Przelewy24), ul. Pastelowa 8, 60-198 Poznań, Poland, NIP 7792369887, KRS 0000347935. The available payment methods are shown before you confirm an order and include BLIK, instant bank transfers and payment cards. The Operator does not store card details.
A purchase confirmation is sent to the email address on the account. An invoice is issued on request sent to [email protected].
Institutional customers (nurseries, kindergartens, schools and other entities buying the service for their business) may contract with payment by invoice on deferred terms. Those arrangements are agreed individually - write to [email protected].
6. Delivery time
The services are supplied electronically and involve no physical delivery. Access to a purchased pool of minutes is activated immediately after the payment provider confirms the payment, and no later than within 24 hours.
Generating a single story usually takes from a few to several dozen seconds; adding narration and illustrations can extend that to a few minutes. The finished story is saved to your account and stays available for as long as the account exists.
If a payment is not confirmed, or access is not activated within that time, please contact the Operator at [email protected].
7. Right of withdrawal
A consumer, as well as a sole trader entering a contract that is not of a professional character for them, may withdraw from a distance contract within 14 days of concluding it, without giving a reason and at no cost.
It is enough to send a statement of withdrawal to [email protected] or in writing to the Operator's registered address. No form is required - a clear statement identifying the account is sufficient. Payment is refunded promptly, no later than 14 days after the statement is received, using the same payment method unless you expressly agree otherwise.
Important exception for digital content. Under Article 38(1)(13) of the Polish Consumer Rights Act, there is no right of withdrawal for digital content delivered before the withdrawal period expires, where the user gave prior express consent and acknowledged losing that right. In practice this means the refund covers the unused part of the minute pool, while stories already generated count as delivered and are not refundable. That consent is given knowingly at checkout; without it, delivery only begins after the 14 days have passed.
The right of withdrawal does not apply to institutional customers buying the service for professional purposes.
8. Complaints
A complaint may be submitted in any form, in particular by email to [email protected] or in writing to the Operator's registered address.
To speed things up, it helps to include:
- the email address of the account concerned,
- a description of the problem and when it occurred,
- how you would like it resolved.
The Operator reviews complaints within 14 days of receipt and replies within that same period to the address the complaint came from. No reply within that time means the complaint is upheld as requested.
Filing a complaint does not affect statutory rights regarding digital content that does not conform to the contract, nor the right to pursue claims in court.
9. Out-of-court dispute resolution
Consumers may use out-of-court complaint and redress procedures, in particular by applying to a permanent consumer arbitration court or to a district (municipal) consumer ombudsman, and may seek help from the Provincial Inspectorate of Trade Inspection.
The EU online dispute resolution (ODR) platform is also available at ec.europa.eu/consumers/odr.
Using these routes is voluntary for both parties.
10. Liability
The Operator is not liable for interruptions to the Service caused by technical reasons, maintenance or force majeure.
The User uses the Service at their own risk. The Operator is not liable for the consequences of using generated content.
These limitations do not exclude or limit the Operator's liability to the extent it cannot be excluded under mandatory law, in particular towards consumers.
11. Changes to the terms
The Operator reserves the right to amend these terms. Users will be notified of material changes by email or via the Service with at least 14 days' notice.
